La Corte UE sul Dieselgate

Sull’ormai noto caso Dieselgate è intervenuta la Corte di Giustizia UE. La Corte ha stabilito che un costruttore di automobili stabilito in uno Stato membro, che proceda a manipolazioni illecite su veicoli commercializzati in altri Stati membri, può ragionevolmente attendersi di essere citato dinanzi agli organi giurisdizionali di tali Stati”. La Corte Ue ha inoltre rilevato che il danno consiste in una riduzione del valore dei veicoli risultante dalla differenza tra il prezzo che l’acquirente ha pagato per tale veicolo e il valore reale di quest’ultimo dovuto all’installazione del software. In merito alla competenza del giudice la Corte ha stabilito che "in materia di illeciti civili, i regolamenti europei coferiscono una competenza speciale all’organo giurisdizionale del luogo in cui si è concretizzato il danno e a quello del luogo in cui si è verificato l’evento generatore di tale danno. Di conseguenza, il convenuto può essere citato, a scelta dell’attore, dinanzi al giudice dell’uno o dell’altro luogo”.
