Liti Condominiali: i diritti del condomino dissenziente

In alcune situazioni l'assembra di condominio è chiamata a decidere in merito alla possibilità di istaurare o di resistere ad una lite avverso terzi, altri condomini e/o l'amministratore.

Siccome in sede assembleare queste decisioni vengono assunte con la maggioranza dei condomini il Codice Civile ha previsto all'art 1132 c.c. che : "qualora l'assemblea dei condomini abbia deliberato di promuovere una lite o di resistere a una domanda, il condomino dissenziente,con atto notificato all'amministratore, può separare la propria responsabilità in ordine alle conseguenze della lite per il caso di soccombenza. L'atto deve essere notificato entro 30 giorni da quello in cui il condominio ha avuto notizia della deliberazione. Il condomino dissenziente ha diritto di rivalsa per ciò che abbia dovuto pagare alla parte vittoriosa. Se l'esito della lite è stato favorevole al condominio, il condomino dissenziente che ne abbia tratto vantaggio è tenuto a concorrere nelle spese del giudizio che non sia stato possibile ripetere dalla parte soccombente".
